Welcome to SquishyMax. These Terms of Service ("Terms") govern your use of the website at squishymax.com and all related services (together, the "Service"), operated by SquishyMax ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use SquishyMax

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian, and you may not buy or sell on the marketplace without their supervision. By using the Service you represent that you meet these requirements.

2. Accounts

Some features require an account. You are responsible for the activity that happens on your account and for keeping your login credentials secure. You must provide accurate information and may not impersonate another person, use another user's account, or create accounts by automated means. We may suspend or terminate accounts that violate these Terms.

3. Marketplace and the Pristine Rules

The SquishyMax marketplace exists so collectors can buy and sell Squishmallows plush in verified, like-new condition. By listing an item for sale, you agree to the Pristine Rules:

• Freshly washed. Every item must be cleaned before shipping, without exception.
• No damage. Items with holes, rips, tears, stains, odors, or repairs may not be listed. Listings that misrepresent condition will be removed.
• Returns for condition. If an item arrives in a condition that does not match its listing, the buyer is entitled to return it to the seller for a full refund. Sellers are responsible for items that fail a condition check.

You are responsible for the accuracy of your listings, for shipping sold items promptly and safely, and for complying with all applicable laws, including tax obligations, in connection with your sales. SquishyMax is a venue for transactions between collectors; except where required by law, we are not a party to transactions between buyers and sellers.

4. Your content

You keep ownership of the photos, videos, listings, posts, and other content you share on the Service. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content for the purpose of operating, promoting, and improving the Service. You represent that you have the rights to the content you post.

5. Community conduct

You agree not to:

• harass, threaten, or bully other users;
• post content that is unlawful, hateful, sexually explicit, or targets minors;
• scam, defraud, or mislead other collectors, or manipulate marketplace prices;
• list counterfeit, stolen, or recalled items;
• spam, scrape, or access the Service by automated means without permission;
• interfere with the operation or security of the Service.

We may remove content or restrict accounts that violate these rules, at our discretion, with or without notice.

6. Intellectual property and fan-site status

SquishyMax is an independent, fan-operated community. Squishmallows and related names, logos, and characters are trademarks of their respective owners, including Kelly Toys Holdings, LLC and Jazwares, LLC. SquishyMax is not affiliated with, sponsored by, or endorsed by those companies. All SquishyMax names, logos, mascots, and site designs are our property and may not be used without our permission.

7. Copyright complaints

If you believe content on the Service infringes your copyright, contact us with (a) the material you believe is infringing, (b) where it appears on the Service, (c) your contact information, and (d) a statement that you have a good-faith belief the use is unauthorized. We will review and, where appropriate, remove the material.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any item sold through the marketplace will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, SquishyMax and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim arose.

10. Changes to the Service and these Terms

We may modify or discontinue parts of the Service at any time. We may also update these Terms; if we make material changes we will post the updated Terms here with a new effective date. Continuing to use the Service after changes take effect means you accept the updated Terms.
